Jhapa. The mayor and deputy mayor of Birtamod, Jhapa, have demanded serious initiative from the Commission for the Investigation of Abuse of Authority (CIAA) regarding the dispute over 51 bigha of land at New Bus Park in Jhapa.
During the discussion held at Birtamode, Mayor Pabitra Mahatara Prasain and Deputy Mayor Nagendra Prasad Sangraula drew the attention of the Commission’s office-bearers towards the land dispute of New Bus Park, the land dispute over the Domalal Rajbanshi Stadium at Birtamod-3 and the problems related to the land of Aduwa Khola and Satanu Paini. Joint Attorney General of the Commission for the Investigation of Abuse of Authority (CIAA) Hari Prasad Regmi and Chief of the Commission’s Koshi Province Office Yagya Subedi were present in the discussions. Mayor Prasain said that 400 families have been facing problems due to the dispute related to 51 bighas of land at Birtamod New Bus Park. He said that the role of the CIAA was necessary to create an environment conducive for the victim’s family to get justice by identifying the real condition of the land that has been under dispute for long. Deputy Mayor Sangraula also said that the local government’s activities have been affected due to the dispute over the land. Stating that a large number of cases and disputes related to land were facing the Commission, he demanded that the Commission should take initiative to resolve the problem by conducting an impartial investigation into the issues related to the ownership of public land, rivulets and penis.
Similarly, irregularities have been found in the land of Domalal Rajbanshi Stadium at Birtamod-3, the mafia has registered the land in their possession and the environment for investment has deteriorated due to problems in the land.
The participants in the discussion have accused Deviguthi of creating a fake tenant by converting the land of Deviguthi into Rajguthi and encroaching on the stadium land by preparing fake land certificates. They said that the dispute regarding the land of the stadium needs investigation into the records of the guthi, the process of keeping the tenant, the ownership of the land and the validity of the ownership certificates. The discussion stressed that the bodies concerned should take effective steps to protect the land used for public and community purposes. Shanta Adhikari of Udayapur said that she and her family have been facing problems for a long time due to land disputes. According to her, people associated with some land entrepreneurs of Birtamod have prepared fake ownership certificates and pressured them to transfer the ownership of the land to 15 katthas of land in their name, including helping them to convert 15 kattha land into 15 bigha and returning one bigha of land.
Adhikari said that they have not been able to get justice even after filing a complaint at the central office of the Commission for Investigation of Abuse of Authority and Koshi Province Office, Itahari. He complained that the problem has not been resolved even after visiting various government offices to resolve the land dispute.
Adhikari became emotional while narrating her pain. After listening to her complaint, Subedi, the chief of the commission’s Koshi Province office, expressed his commitment to provide necessary support to get justice to the Adhikari’s family, which has been in trouble for a long time.
“Today a woman is heartbroken to cry with tears in her eyes,” Subedi said, “The CIAA will take this matter seriously and take necessary initiatives for justice.” The judicial committee of the Survey Office, District Police Office, Jhapa, Bhadrapur Land Revenue Office, Bhadrapur and Mechinagar Municipality also discussed the allegations made by the officials and the dispute regarding the ownership of the land.
The Adhikari family has also submitted documents to the CIAA seeking registration of the land sold by Prakash Upreti of Birtamode 5 in the name of Raunak Giri of Birtamode 6. Raj Kumar Oli, chairperson of Consumer Awareness Campaign, Birtamode, demanded investigation into the issue of land shown in the map of Aduwa Khola and Satanu Paini being registered in the names of individuals.
Even in the map of 2021, it is seen that the land was registered in the name of individuals at the time of the implementation of the snake, and some people have also been found to have built boarding schools and houses on the land.
He said that action should be taken against the culprits after examining the legality of such public rivers and water land registered in the name of individuals. During the discussion, Joint Attorney General Regmi recalled that he had also argued in the court regarding the 51 bigha land of Birtamod New Bus Park and the government of Nepal should take it seriously. Subedi said that the commission would seriously investigate the issue related to ginger river and Satanu Paini and take legal action if the irregularities were proved.
Spokesperson of Birtamod Municipality and Ward No. Ward No. 1 Chair Agni Pandey underscored the need of coordination among the government bodies and effective investigations to resolve the disputes related to land, rivulets and water.
The discussion with the CIAA has been seen as important at a time when the land dispute of the new bus park in Birtamod area, allegations of encroachment on the land of the stadium and the registration of the land of Khola and Paini are being raised.
The reality of the dispute is expected to be clear from the impartial investigation of the land records, documents related to Guthi, ownership certificates and registration process. Ward chairpersons, branch heads and locals of Birtamod Municipality were also present in the discussion.
