Discussion in the Legislative Committee on keeping the National Investigation Department under the Home Ministry or the Prime Minister’s Office
Kathmandu. Law Minister Sobita Gautam has said that the current bill can decide only on whether to keep the National Investigation Department under the Home Ministry or the Office of the Prime Minister and Council of Ministers.
Speaking at a meeting of the Legislation Management Committee on Wednesday, Minister Gautam said that the National Investigation Department should be decided by discussing under whom to keep the National Investigation Department. Today’
s meeting held clause-wise discussions on the ‘Nepal Special Service Act, 2042 BS Bill, 2083’.
In the discussion, she said, “Today’s discussion is very brief on the subject matter of the bill related to restoring the existing provisions of our Nepal Special Service Act. In particular, where should the national investigation be taken, there is only one issue that we have to discuss and decide today. If it is necessary, it is possible to decide only whether it should be kept under the Ministry of Home Affairs or under the Prime Minister’s Office. Minister Gautam said that while amending the bill, discussion and decision should be taken only within the limits of the prescribed clauses. According to him, the bill is an attempt to revive the system that was under the Prime Minister’s Office in the past.
She said, “Because, we all know that when bills are being amended, we know the limits of amendment of bills, we focus only on the clauses that we have brought out. Now the section that has been raised again was under the Prime Minister’s Office under the previous system. She said that during the previous government led by the then Prime Minister Sushila Karki, an ordinance had made provision to keep the National Investigation Department under the Ministry of Home Affairs.
“In the meantime, Sushila Karki, who was the then prime minister after the Jenji movement, brought the ordinance and brought it again so that it would be under the Ministry of Home Affairs,” she said.
However, the ordinance has not been replaced, according to Minister Gautam.
She said, “And then we should have replaced it again, but we did not replace it. Because we did not replace it because we thought it would be okay to have the old system under the Prime Minister. When it was not replaced, the ordinance that ran the section became empty, in a way, it went into a vacuum.” Now we have brought this bill to wake it up.” Minister Gautam said that there could be extensive discussions in the committee on the need to make the National Investigation Department more powerful and efficient. However, he said that the final decision will be taken on whether to place the department under the Home Ministry or the Prime Minister’s Office as the content of the current bill is limited.
She said, “When you are discussing this definitively, there will definitely be things like that the national research needs to be strengthened, the capacity is not enough, and more components need to be added to it. Those things are very similar to our concerns, we have to work on how to make them better.” ’
