Kathmandu. Rastriya Swatantra Party lawmaker Shraddha Kunwar Chhetri said that if a complaint is filed against a person, the person is not guilty and the legal process should be initiated only after the preliminary fact check of the complaint. <\/p>\n
Speaking in the House of Representatives meeting held on Thursday, Chhetri said that although it is the right of the citizens to file complaints, it is the responsibility of the state to protect the real complainant. However, he said that the tendency to blame people on the basis of complaints is increasing. <\/p>\n
Stating that the Constitution has guaranteed the principle of holding a person innocent until a person is proven guilty, in practice there is a tendency of seeking clarification on the basis of baseless complaints, disclosing the names of the persons and presenting them as the guilty through social sites. <\/p>\n
She also raised the question of who will take responsibility for the damage caused to the profession, reputation and family of the person concerned if the allegations are not proved. Chhetri said that although there is a provision for false and malfeasance complaints in the Civil and Criminal Code and the law related to corruption, the maximum fine is only five thousand rupees. <\/p>\n
She stressed that a preliminary inquiry should be conducted based on the facts of the complaint and if there is sufficient basis for the allegations, the investigation and legal process should be carried out in an impartial manner. She also demanded that the provision should be effectively implemented to bring the person who makes false or baseless complaint with the intention of defaming someone.<\/p>\n","protected":false},"excerpt":{"rendered":"
