Kathmandu. The Parliamentary Hearing Committee (PHC) on Friday discussed the complaints against the proposed Supreme Court judges. <\/p>\n
In the meeting of the committee, the proposed justices of the Supreme Court, Dr. Ratna Bahadur Bagchand and Chandra Bahadur Saru were invited and discussed with the complainants. <\/p>\n
Senior advocate Rajesh Kafle said that the proposed judges of the Supreme Court.<\/p>\n
Stating that he had filed complaints against Ratna Bahadur Bagchand, Chandra Bahadur Saru, Janak Pandey and Gokarna Dangi, he questioned the process and criteria for appointment of judges. <\/p>\n
He said that he wanted to express his views on procedural issues based on his experience of advocating in the Supreme Court for a long time. <\/p>\n
“The Supreme Court is the court of record. Everyone should follow all the rules and laws that it says. The Constitution of Nepal has enshrined the right to protect the fundamental rights of the people in the Supreme Court,” he said, adding, “If the state agencies violate the rights of the people, the court is the only institution that can protect them. Therefore, the judges appointed there should be of high character, competence, expert in law and clean.” “<\/p>\n
reminding them of the qualifications and criteria stipulated in Article 129 of the Constitution and Clause 5 of the Judicial Council Act, 2073 BS for the appointment of judges, he said that competency, seniority, experience, knowledge of the subject, efficiency, honesty, impartiality and ethical conduct should be the basis for the appointment. <\/p>\n
Giving an example of international practice, he said the United Nations’ 1985 Basic Principles on the Independence of the Judiciary have also given importance to competence, impartiality and justice consciousness in the appointment of judges. Kafle said that various questions have been raised about the judiciary in recent times and the allegations related to political influence and corruption in the appointment of judges should be taken seriously. <\/p>\n
“There are three types of allegations being made in our judiciary. Number one, it is that the judges are recruiting cadres of the sister organizations of political parties. Second, there is widespread corruption in the judiciary. This is not an allegation made by me, it is a question that has been raised publicly,” he said. <\/p>\n
He claimed that the issue of corruption in the judiciary has also been raised in the report of the Chief Justice and the report of the Supreme Court Bar Bench. He made it clear that it was not his intention to question the personal dignity, dignity and prestige of the proposed judges and said that judicial competence and impartiality should be given priority in the appointment process. <\/p>\n
Similarly, another complainant, Parmeshwar Bhetwal, questioned the performance of the proposed judge and claimed that the date and signature of the ‘release request’ document submitted to the court were suspicious. He alleged that the document was forged and submitted, saying that there was no match between the dates mentioned in it and the signatures of the employees. <\/p>\n
is said to be a release request, which has been submitted in a fraudulent manner. It also mentions all the details while looking at the dates. The dates signed by the staff are also made in the latest backdate,” he said. <\/p>\n
He raised the issue of the decision in favour of the company in the related case and said that there was a question in the decision process. He said that the date mentioned on the first and second pages of the document and the signature of the employees will be clear if the truth is checked. <\/p>\n
In the meeting, lawmaker Madhu Chaulagain asked the complainant to prove the allegation that another order was prepared by tearing the order and another order was made after the case was filed at the civil level. He also questioned whether he had applied to the Judicial Council to preserve the CCTV footage related to the incident. <\/p>\n
‘You have alleged in the complaint that the order was torn up and another order was prepared or another order was prepared after it came to the civil level. What basis do you have to prove it? You have said that the CCTV footage should also be examined. Have you mentioned in your petition to the Judicial Council to secure the CCTV footage? Because I don’t think the footage will last more than three months,” he asked. <\/p>\n
