Culture expert Som Dhimal said although the inclusion of constitutional provisions in the Non-Physical Cultural Heritage (Protection) Bill-2081 was positive, it should be more clearly incorporated on the rights of the community, UNESCO enlistment, intellectual property and dividend distribution. <\/p>\n
Speaking at an interaction program with stakeholders on the Non-Physical Cultural Heritage (Protection) Bill, 2081 BS, Dhimal said that the inclusion of provisions related to protection as per the constitution in the preamble of the bill and presenting alternatives to some definitions and names was a positive aspect. Stating that Nepal has not been able to register any new element in the list of UNESCO’s Non-Material Cultural Heritage in 16 years, he said the State should pay special attention to it.”From the point of view of the Government of Nepal, even after a gap of 16 years, we have not been able to register or list a single archaeology in any genre under UNESCO,” he said.<\/p>\n
Maybe it needs to be corrected. It has just moved forward for a listing. Let’s hope we get positive results. “<\/p>\n
Dhimal said that the public awareness and empowerment program has not reached the community level effectively, it has not been linked to the livelihood of practitioners of non-material cultural heritage and the listing process has not been extended effectively to the state and local levels. <\/p>\n
According to him, there is a great opportunity for the state to formulate policies to link the cataloguing of inmaterial cultural heritage with the participation of the community, education, tourism and income generation. He said, “We are behind in the mass awareness campaign of empowerment to the community.<\/p>\n
It has not yet reached the upper corner, Kapchha, rural municipality and municipalities. The center and some areas have been able to do so only at the provincial level. We have not yet been able to connect the practitioners of another ICH and the community, now living human personalities, with their livelihoods, economic earnings. “<\/p>\n
Dhimal suggested that the preamble of the bill include international contexts such as the Ancient Monuments Protection Act, the National Culture Policy, the World Heritage Convention (1972), the Convention on the Diversity of Cultural Expressions (2005), the United Nations Declaration on the Rights of the Indigenous Peoples (UNDRIP) and the Convention on Biological Diversity. <\/p>\n
He also urged the government to clearly address the relationship between non-material cultural heritage and education, gender equality, climate change, human rights, sustainable development, tourism, science and technology, natural disaster management, media and intercultural understanding. According to him, the provisions of the bill should include provisions related to community prior approval (FPIC), right to intellectual property, listing process, dividend distribution, emergency protection, National Non-Physical Cultural Heritage Fund, support system and urgent safeguarding list, representative list and best practice list in the bill. He also urged the lawmakers to consider the provisions related to community participation, gender equality, dividend distribution, listing of common cultural heritage, disaster risk reduction, sustainable development and protection of intellectual property while formulating laws.
