Judges with high moral character are needed: Sulabh Kharel
Kathmandu. The meeting of the Law, Justice and Human Rights Committee held discussions on the present status of independent judiciary and justice administration, problems and its solution.
Rastriya Swatantra Party (RSP) lawmaker Sulav Kharel said that the justices of the Supreme Court should have high moral character.
Stating that reforms in judiciary were necessary, he stressed the need for serious discussion on necessary amendment in the constitution and legal provisions.
He said, “Being a judge of the Supreme Court should be a character of high morality. If we can move that amendment forward, it can bring it into the internal system, then the reform of the judiciary is the concern of the government agencies or all the stakeholders. There are some things that need to be improved. He said that the reform of the judiciary was a matter of common concern for the government, concerned agencies and stakeholders. He also said that there is a need to improve in some areas.
Lawmaker Kharel said that there should be a clear debate on the limits of the court’s interference in the laws made by the parliament.
He said that there is not enough constitutional debate on the extent to which the Supreme Court can intervene in policy matters.
‘The court is trying to intervene in the things that Parliament makes. But we have not discussed whether the Supreme Court can make a policy intervention in our Vedic debate,” he said, “Even when the bill to extend the term of the Constituent Assembly is going to the House, we have given an interim order not to move the bill forward.” Whether to use social media with or without registration is a matter for this House to speak or to speak by code. It should be a matter of how this affects democracy. Citing the bill related to constitution amendment and the issue related to social media regulation as examples, he said that there was a need for clarity on the demarcation between the role of the judiciary and the parliament’s decision. He said that there should be a serious review of the impact of such issues on the democratic system.
