Surkhet. The then member secretary of the Karnali Province Sports Development Council, Bishwamitra Sanjyal, has filed a writ petition at the Supreme Court against the state government for not providing him with the salary and facilities he was supposed to get.

Sanjyal has filed a writ petition demanding salary and facilities for the period he worked as a member secretary. A single bench of Justice Tek Prasad Dhungana on Wednesday issued a show cause order in the name of the defendants and sought a written reply on his petition.

Sanjyal filed the writ petition naming the Office of the Chief Minister and Council of Ministers, the Provincial Assembly, the Ministry of Social Development, the concerned minister, the Karnali Province Sports Development Council and the Ministry of Federal Education and Sports as the defendants. The Supreme Court has directed the defendants to submit a written reply through the Office of the Attorney General or the Office of the Chief Attorney within 15 days as to why the order should not be issued as demanded by the petitioner.

Sanjyal has claimed that he has not received salary and facilities for 17 months and 5 days from Shrawan to Poush 2081. Since it is a matter of salary and allowances, the Supreme Court has also ordered to proceed with this case giving priority to this case.

The cabinet meeting chaired by the then Chief Minister Mahendra Bahadur Shahi had appointed Sanjyal as the member secretary of the Karnali Province Sports Development Council on December 23, 2020. He was appointed as the member secretary of the Sub-section (2) of Section 6 of the Sports Development Act, 2076.

The process of amending the Act was initiated due to lack of clarity on the tenure of the office bearers of the council, the structure up to the district level and other provisions in the Sports Development Act. The bill to amend the Sports Development Act, 2076 was first registered in the Provincial Assembly on February 29, 2021. However, the bill could not be passed in the first term.

After the start of the second term of the Provincial Assembly, the bill was re-registered on March 12, 2020 and sent to the Social Development Committee. The bill was withdrawn by the then Social Development Minister Khadga Pokharel, who was stuck in the committee for a long time.

Sanjyal claimed that the issue of remuneration and perks of the member secretary has been confused due to the lack of amendment to the Act.

The ordinance issued by the Council of Ministers led by the then Chief Minister Shahi had made provision for the member-secretary to receive remuneration and facilities equivalent to an officer of the eleventh level.

During the promulgation of the ordinance, Sanjyal had received remuneration and perks twice. After that, he claimed that his wages and facilities were stopped for 17 months and 5 days.

Sanjyal’s leadership in the construction of the stadium

Under the leadership of Sanjyal, the construction of the provincial stadium in Birendranagar was started. This stadium is considered as an exemplary structure in the sports infrastructure of Karnali.

Sanjyal’s term ended in Poush 2081. After not getting the salary and facilities that he was supposed to get even after the end of his tenure, he went to the Supreme Court for judicial treatment.
