Separate Act needed for implementation of verdict: Minister Gautam
Kathmandu Minister for Law, Justice and Parliamentary Affairs Sobita Gautam has said that the lack of implementation of the verdicts of the court is a serious issue. She said that a separate act of integrated nature is necessary to make the implementation of the verdict effective.
Speaking at a meeting of the Law, Justice and Human Rights Committee on Thursday, Minister Gautam said that the present status of the verdict, challenges and future course of action will be discussed with the Decision Enforcement Directorate.
She said, “The verdict is implemented, but there are many backlogs in the court as well. People are realizing that it took years for the verdicts to be delivered. The process itself is painful. A person in pain has to wait for many years to get the final verdict from the court, and even if the verdict is finally delivered, it is painful when it is not implemented.” “
Minister Gautam said that the backlog in the court should be reduced and the problems in the implementation of the decisions made by the court should be identified and resolved. He said that the main problem in the implementation of the verdict is the ‘implementation gap’.
Minister Gautam said that the existing institutional structure of the implementation of the verdict should also be reviewed.
Stating that it is difficult to implement the verdict in the current context, he said that the structure should be built in a new model.
She said, “It seems that the institutional architecture related to the implementation of the judgment should be made in a new way. We have been working in one way for many years, but in the current context, the implementation of the judgment is not possible in this way.” She said that the right to justice will be ensured only after the implementation of the verdict and the implementation of the judgment should be taken as the most important aspect of the justice system.
“The right to justice only happens when there is effective enforcement of justice,” she said.
If the Right to Justice is not judgment enforcement, how can we insure, how can we ensure the right to justice as written in the constitution? Therefore, the implementation should be given the most attention. Minister Gautam said that there is a need to formulate a separate act regarding the implementation of the verdict of an integrated nature as the verdict is being implemented on the basis of various laws.
According to him, there are various mechanisms of justice disposal including the judicial committee at the local level along with the implementation of federalism, so all these structures should be made effective by linking them with the implementation of the verdicts.
She said the delay in the implementation of the verdict would weaken people’s faith in the justice system. He said that the implementation of the verdict should be linked to the root by building the necessary structure as per the federalism.
Minister Gautam also said that a time-bound mechanism is necessary for the implementation of the verdict. She said that it takes years to get a verdict from the court and the situation of not being implemented for decades even after the verdict has been delivered, should be ended.
Minister Gautam said that the implementation of the verdict can be made transparent and effective through the use of information technology. He said that the implementation of the verdict can be easily monitored if the work to be done by the district, high and supreme courts as well as the government can be connected through the digital system.
She said that legal and policy ambiguities could also be behind the problems seen in the implementation of the verdict, adding that the government was now working seriously on this issue.
