Two-thirds government is moving towards abolishing autonomous bodies: President Dr. Mishra
Kathmandu. President of Nepal Bar Association Dr. Bijay Prasad Mishra has raised serious questions about the administration of criminal justice in the country.
He expressed concern that the judiciary should have implemented the law mechanically instead of dispensing justice judiciously while using the law.
Speaking at the 25th annual general meeting and handover of office of the High Court Bar Association Patan on Saturday, Mishra accused the government of abolishing the two-thirds majority autonomous bodies. Although the role of legal experts and jurists is important in the Nepal Law Commission, he said that the Nepal Bar Association has opposed the proposal to appoint ministers and secretaries of the civil administration. He said, “Now there is a two-thirds majority government. The government is working towards abolishing the autonomous bodies. It is not clear why the minister himself went to the place where the special lawyers of the Nepal Law Commission should have been presented.
How relevant is it that the minister himself should sit in the place where the jurist should be seated, and the secretaries of the civil administration should be placed. The preamble of the Law Commission has also been done in the same way. The Nepal Bar Association has opposed it. We believe that a jurist should sit in the Law Commission. Mishra also expressed dissatisfaction with the current state of the administration of criminal justice. He said that pressure is being created on the judiciary from various sectors including social media, NGOs and it will be difficult for the judiciary to work independently.
He said that the law should be used in a sensitive and prudent manner even in cases related to coercion.
He questioned the situation where a case of rape followed by a long jail term would be filed after betrayal in a love affair, he stressed that the court should also look into the nature and circumstances of the case.
On the occasion, Chief Judge of the Patan High Court, Lal Bahadur Kunwar, said that the working committee of the High Court Bar Association Patan has carried out important works regarding court management, facilities to service seekers and ensuring access to justice. He said that the Bar Association has been working constructively to facilitate the relationship between the court and the service recipients even in difficult and difficult situations. He said that the Bar Association has been successful in working as a bridge between the court and the citizens.
He said, “The Executive Committee of the Bar has been continuously working in various aspects of court management from the point of view of the convenience of the service recipients. It has worked creatively to facilitate the court and the service recipients in difficult and difficult situations and to ensure access to justice. The Bar Association has been able to act as a bridge between the service recipients and the general public. The role of the court, lawyers and the Bar Association was also discussed in the 25th Annual General Meeting and Handover of Responsibilities of the High Court Bar Association Patan.
