Prisoner murder case: 15 sentenced to life imprisonment

Kathmandu. The court has sentenced 15 people to life imprisonment for the murder of two inmates at the District Prison in Sankhuwasabha. Binod Tolangi, 20, of Madi Municipality-5 and Aakash Balami, 28, of Kakani Rural Municipality-7 of Nuwakot district were beaten to death by security personnel and some inmates in the District Prison on August 9, 2080.

Investigations revealed that two inmates were killed when they were first beaten up by police and later by other inmates for trying to escape by cutting the rod of the toilet window of the prison. According to Ujjwal Neupane, registrar at the District Court, 15 people including seven police personnel have been sentenced to life imprisonment for the murder of two prisoners. A single bench of Justice Raj Kumar Koirala handed down the sentence to life imprisonment as per Clause 171 (1) of the Maluki Criminal Code-2074 BS.

Similarly, as per Section 186 of the Code, the defendants have decided to pay compensation to the next of kin of Tolangi and Balami each as per Section 186 of the Code. Investigations revealed that the inmates were first beaten to death by the police and then by other inmates for trying to escape by cutting the rod of the toilet window of the prison.

Seven police personnel were sent to Dhankuta jail and eight to Tehrathum jail on the charge of murder. Those sentenced to life imprisonment are Assistant Sub-Inspector Laxmi Chaudhary, Police Constable Suman Gurung, Head Constable Raj Kumar Shrestha, Police Inspector Pawan Kumar Mahato and security guard Nusan Rai.

Likewise, the court sentenced life imprisonment to security guards Ram Karki, Anish Sharma Kattel, Sachin Rai, Suman Saru Magar, Tikaram Chauhan and Nabin Kumar Rai and inmates Min Bahadur Tamang and Indra Dhoj Ghimire. Seven police personnel and eight inmates, including Assistant Sub-Inspector (ASI) of the District Prison, were arrested for the murder. A single bench of District Court Judge Teknath Gautam had issued an order to send seven police personnel to Dhankuta and eight to Tehrathum.
