Kathmandu. It has come to light that the Nepal Telecommunication Authority (NTA) has taken action against the mobile service provider Ncell for charging more than one billion rupees by operating various Value Added Services (VAS) that are auto-renewed without the clear approval of the customers.
According to the regulatory investigation conducted at that time, Ncell was found to be operating Huawei App Gallery and various services under Gameloft in such a way that they would auto renew without the customer’s prior approval. The authority had taken action against the company declaring it to be against Section 47 (1) of the Telecommunications Act, 2053.

The Authority’s Decision No. According to Section 4343, the concerned customers were instructed to return the 1 billion 11 crore 12 lakh 67 thousand 651 rupees 10 rupees collected from the customers from 1 August 2, 2018 to March 1, 2077 through Daily Renewal, 3-Days Renewal, Weekly Renewal and Monthly Renewal Pack.
The decision has also asked to submit the details of the refunded amount to the Authority on a monthly basis and to disseminate the information related to the refund to the customers through appropriate communication. If the customer could not be identified, the amount to be returned should be kept in a separate fund and the authority should be informed about it.
Ncell was also fined Rs 50,000 in the same case. The company has also been asked to submit details of how much revenue it has earned from the service within 15 days.
During the investigation, the authority also pointed out that different terminology was used in the subscription page, SMS notification, mobile app and billing system to mislead the customers. The company was instructed to clearly provide information about which services they have activated, how much they are paying and how to deactivate the service.
The authority had also asked the company to make arrangements for customers to shut down the service easily and develop a system that can view all the information related to the active service through the Ncell Mobile App.

According to consumer rights activists, although the authority has ordered the refund of the money, it is not clear that the amount has reached all the affected customers. They said that the company has not returned the money or the details of how many customers have received it back are not publicly available.
This case has also been mentioned in the government-level investigation report. The report has included the fact that the NEA took action against Ncell for charging money by operating the auto renewal service without the consent of the customers.
