The prevailing legal system says that the service can be provided only with permission.
Section 42 of the Telecommunications Act, 2053 states that licensees can levy and recover fees for providing telecommunication services to customers. The provision mentioned in sub-section (a) of the said section states that the rate of such service charge must be approved by the Authority, the rate of service charge should be reasonable and reasonable and the rate of service charge should be published as per the direction of the Authority.
On the other hand, WorldLink has also ignored the provision that the service providers should publish information about the package with the new fee at least seven days before the implementation after being approved by the authority.
After WorldLink’s refusal, some other service providers are also selling packages without approval, learning from WorldLink’s mischief.
The authority has also admitted that it has been informed that WorldLink has been selling various packages without its approval, but the action process has not moved forward. WorldLink has said that not only itself but other service providers have also done such wrongdoing and the authority itself is responsible for this.
