Senior advocate Jagat Bahadur Karki of the Supreme Court Bar Association has said that training on the art of debate and law firm management is necessary for lawyers. Senior advocate Jagat Bahadur Karki of the Supreme Court Bar Association has said that training on the art of debate, style of presentation in the bench and management of the law firm is necessary to enhance the professional skills of lawyers.

Speaking at a program organized by Nepal Bar Association on the occasion of Bijaya Dashami, Shubh Deepawali, Nepal Sambat and Chhath Festival 2083 BS, senior advocate Karki said that there is a lack of practical skills among the lawyers. He pointed out the need to improve the skills to be adopted while advocating arguments in the court and the ability to answer the questions of the bench.

‘The Professional Skills Enhancement and Lawyers’ Concern Committee, the name of this committee is sacred in itself. We have not been able to develop professional skills and we have not been able to put it into practice. This debate is very important to us,” he said.

Stating that the style of arguing can also affect the outcome of the case, he said that there is a need for training on how lawyers are representing their side. According to him, in some cases, it is difficult for lawyers to answer the questions asked by the bench. He also said that there is a need for clear practical knowledge about the way of entering and leaving the bench, the manner of addressing colleagues and lawyers from the other side.

‘We lawyers do not know how to answer the questions asked by the bench sometimes, we do not know what to answer. How to enter the bench, how to do it when you leave, how to address your colleagues, how to address what the lawyer of the other side has said. This has become very necessary,” he said.

Karki stressed on the need to conduct a comprehensive training program to take the experience and knowledge of experienced senior lawyers to the new generation of lawyers. He suggested that both the new and experienced generation of lawyers should be trained by involving senior lawyers who have been advocating for a long time.

He also mentioned that law firm management is also an important issue for lawyers. He said that how the service recipients come to the lawyer’s office and the kind of treatment and services they get will affect their trust and satisfaction.

‘How are the clients who come to our law firm looking at our law firm? That is very important. The management of a law firm does not need to be big, it does not need to be good, but how to deal with the clients when they come, where to keep them is important,” he said.

He said that not all parties are successful in the case and since some service recipients come to the lawyers with pain, special attention should be paid to their behavior, the style of listening to the problems and the management of the office. He said that the skill of maintaining the trust of the service recipients by treating them properly is also a part of the professional competence of the lawyer. Similarly, Karki drew the attention of the lawyers to the lack of adequate information about the provisions of the Social Security Fund (SSF). He said that although the Nepal Bar Association has signed an agreement with the Social Security Fund, it is yet to explain its importance and usefulness to the lawyers.

‘We also made an agreement with the Nepal Bar Association Social Security Fund. We went to Gandaki Province, we also went to Koshi Province. We tried to explain this to our friends by going to the state. But till now we have not been able to explain it to a little. Understand it, try to understand it,” he urged.
